Murder of a judge in Albania – The wave of support for the perpetrator and the legal consequences

The murder of the judge Astrit Kalaja while on duty constituted one of the most serious incidents in the history of the judiciary in Albania.

The judge was murdered by Elvis Shkambi, whose family was involved in a multi-year legal dispute over a property issue.

While the act itself shocked public opinion and provoked an international backlash, there was a wave of rhetoric on social media in the country that openly justified the perpetrator's act.

Many commentators in media and social networks expressed support for the perpetrator, citing that the judicial system in Albania is corrupt and causes delays that harm citizens.

In the judge's case Castle, a goFundMe page was also Created, inviting albanians To contribute financially to the Elvis Shkambi to cover his lawyer's expenses. This page raised about $14,000, but has now been closed.

However, the draft of the New Criminal code, which is still under consultation, includes a specific article that criminalizes the support or public justification of criminal acts, including comments or posts on social networks.

This specific act, according to article 409 of the draft, carries a prison sentence of 1 to 4 years.

Article 409: Supporting the commission of a crime

  1. Supporting the perpetrator of a crime for the act he has committed, through public praise of his act, support through justification of the act and presentation of it as beneficial, as an acceptable solution to a situation, or insulting, contempt or ignoring the legal order or the fundamental rights of the victim affected by the crime, is punishable by imprisonment of one to four years.
  2. If the support is provided through mass media of any kind, the penalty is increased by up to one third of that amount.
  3. If the support takes place at the time of the commission of the crime and has influenced the perpetrator to continue towards the completion of the act, the supporter is considered an accessory to the commission of the crime. In this case, the crimes are not considered to be converging.

  • Ο “ε γ κ ω μ ι α σ μ ό ς ε γ κ λ ή μ α τ ο ς” αποτελεί έγκλημα προβλεπόμενο σε όλους τους Ποινικούς Κώδικες, όλου του Κόσμου και εάν μπορεί να ελεγχθεί σε κάτι η σημερινή Αλβανία είναι στο ότι έχει παραλείψει να συμπεριλάβει αυτό το έγκλημα στον Ποινικό Κώδικά της, οπότε, πολύ καλώς τον συμπληρώνει έστω και με καθυστέρηση, κάτι που πιστώνεται υπέρ της παρούσης κυβερνήσεώς της.

    Γενικώς, σήμερα, σε όλα τα δημοκρατικά καθεστώτα, οι κατά τόπους δικαστικές αρχές χαρακτηρίζονται από βαθύτατη δ ι α φ θ ο ρ ά διότι οι κοινωνικές δομές όπως διαμορφώνονται από τις “φιλελεύθερες” αντιλήψεις, διαβιβρώσκουν χαρακτήρες και είναι πασίγνωστη η βαθύτατη διαφθορά της “δικαιοσύνης” και στην Ελλάδα όπου, το διεθνούς ντροπής “παραδικαστικό” της, έχει κηλιδώσει ολόκληρη χώρα! Βεβαίως, ευνόητη είναι και η αντιστοιχία τηε διαφθοράς της “δικαιοσύνης” και στην σημερινή Αλβανία και δεν θα μπορούσε να είναι και διαφορετικά αφού και η Αλβανία παρακολουθεί την δημοκρατική υπέλιξη ολόκληρης της Ευρώπης και δη των …Βαλκανίων της.
