Albania: New volume of jurisprudence of the Constitutional Court with OSCE support

Following the publication of the first volume of the Guide to the Jurisprudence of the Constitutional Court in February 2024, which focuses on individual constitutional appeals from the period 1998–2023, the Constitutional Court of Albania, in cooperation with the OSCE Presence in Albania, published on 24 June 2025 the second volume of the Guide, covering the period 1992–2024.

The second volume of the Guide presents the decisions and case law of the Constitutional Court of Albania on the general principles of fundamental rights and freedoms, individual substantive rights, as well as the standards concerning the separation of powers and the organization and functioning of constitutional institutions in Albania — namely the President of the Republic, the Parliament, the Council of Ministers, the Ombudsman, the Supreme State Audit Office, the courts, the prosecution and the local self-government bodies.

Both volumes of the Guide aim to enhance public access to the Constitutional Court of Albania, to better protect fundamental rights and freedoms in Albania, and to support the country's judicial officers in developing their research and analytical skills. At the same time, they contribute to the unification of the Court's jurisprudence in Albania and offer lawyers, legal practitioners and academics in the country a useful tool for more effective study of its jurisprudence.

The preparation of the two volumes of the Guide was supported by the OSCE Presence in Albania, within the framework of its project entitled “Strengthening the Rule of Law and the Protection of Human Rights in Albania through Support to the Constitutional Court”. The project was funded by the United States of America, Italy and Greece.

The OSCE Presence will continue to support the Constitutional Court of Albania in its efforts to enhance its transparency, accessibility and effectiveness, as well as to strengthen its institutional capacities to uphold the rule of law and protect human rights in Albania, in line with international standards and OSCE commitments.
